Terms & Conditions of Service for the SAFEHealth App

Reliant Medical Group, Inc. (“Reliant”) is pleased to offer our patients the ability to share their personal health monitoring device data with their healthcare team through the SAFEHealth App. If you believe that you would benefit from this service, you may sign up for access by contacting your healthcare provider and agreeing to these Terms and Conditions outlined below. If appropriate, your healthcare provider will place an order to connect to your home scale, blood pressure monitor, thermometer, pulse oximeter, activity monitor, or other similar device.

USE OF THE SAFEHealth App

I understand that the SAFEHealth App (“SAFEHealth”) should NEVER be used for urgent health care matters. The anticipated turnaround time for a response to uploaded personal health monitoring device data is two (2) business days. Therefore, if I believe I am experiencing an urgent or life threatening health condition I should phone my physician, go directly to the Emergency Department of a local hospital or call 911 immediately.

If my physician is out of the office or unavailable to respond to my SAFEHealth device data, my data may be routed to another Reliant provider who is part of my care team.

At this time, we anticipate that the SAFEHealth App will provide the following data upload services:

  • Weight
  • Blood pressure and heart rate
  • Body temperature
  • Oxygen level
  • Activity (steps, speed, and location)
  • Diet
  • Sleep patterns
  • Other services may be added as Reliant enhances the SAFEHealth App.

I agree that all monitoring data that are sent through SAFEHealth will be regarding MY PERSONAL health care and conditions. I understand that loading data for advice for a friend or family member is NOT allowed. Since these messages will become a part of my permanent medical record and will be perceived as my health information, it is important that no one else's information be reflected in my data. With my authorization, this information may be released to insurance companies when applying for insurance. Reliant takes no responsibility for erroneous medical information that is provided by me to SAFEHealth that may impact my ability to be covered by insurance. Without my authorization, medical information may be released to my insurance for payment of my healthcare claims.

These Terms and Conditions are a binding agreement between me and Reliant. By using or accessing SAFEHealth, I accept and agree to be bound by these Terms. This agreement and use of SAFEHealth shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts.

PROHIBITED USES

In addition, the following are other prohibited uses and/or activities that may result in termination of SAFEHealth access:

Overuse and/or abuse of the SAFEHealth functionality; including (but not limited to) sending data without calling Reliant for urgent matters.
Falsifying your data; and
Including data from other individuals.
The above list is not all inclusive and other prohibited uses and/or activities may result in termination of SAFEHealth access at the discretion of Reliant.

TERMINATION OF SAFEHealth PRIVILEGES DUE TO PROHIBITED USE:

Reliant reserves the right to deactivate access to SAFEHealth. The following measures will be taken before deactivation:

1st offense: re-education
2nd offense: warning
3rd offense: deactivate SAFEHealth
CONFIDENTIALITY

Both Federal and Massachusetts state laws govern the confidentiality of medical information. Reliant is dedicated to keeping medical information confidential. Reliant employees are subject to strict standards on maintaining confidentiality. Since Reliant Medical Group is providing access to medical information I must share this responsibility. Please read Reliant's privacy statement and Notice of Privacy Practices for more information. I recognize that it is my responsibility to ensure the security of my own healthcare information before and after I load it electronically through SAFEHealth.

PERSONAL IDENTIFICATION CODE AND PASSWORD

I understand that I will be given a unique access code by Reliant to allow me access to SAFEHealth for each type of monitoring device. The first time I log into SAFEHealth I will be required to enter the unique access code and the last 4 digits of my social security number. Anyone with access to my social security number and the unique access code would be able to upload fake data into my Reliant medical record. It is my responsibility to not share my unique access code with anyone and to appropriately destroy it after I use it.

I understand that if Reliant discovers that I have inappropriately shared my unique access code or that I have abused my access privileges, Reliant may terminate my participation in SAFEHealth. I understand that Reliant takes no responsibility for and disclaims any and all liability for damages arising from a breach of medical record integrity resulting from my sharing or losing my unique access code.

AVAILABILITY

I understand that SAFEHealth may not always be available to me due to system maintenance, back-ups or failures. Access is provided on an "as available,” basis and I am not guaranteed access at any particular time.

SECURITY

Reliant has taken steps to ensure that your personal healthcare information is protected by state of the art electronic security measures, including 128 bit encryption, to prevent unauthorized access to your information through the internet. We also monitor our internet link on a regular basis to detect any inappropriate attempts to access protected health information.

DISCLAIMER FOR INFORMATION PROVIDED ON LINKS TO OTHER SITES

I understand that Reliant may provide links or reference to other sites but RELIANT has no responsibility for the content of such other site and shall not be liable for any damages or injury arising from that content. Any links to other sites are provided as merely a convenience to the users of this web site.

INDEMNIFICATION

As a condition of my use of the SAFEHealth, I agree to indemnify and hold Reliant and its Third Party Content providers harmless from and against any and all claims, losses, liability, costs and expenses (including but not limited to attorneys' fees) arising from my use of the SAFEHealth, or from my violation of these Terms and Conditions.

COPYRIGHT AND TRADEMARK POLICIES

SAFEHealth is protected by applicable copyright laws. Accordingly, I may not copy, distribute, modify, post or frame-in SAFEHealth, including any text, graphics, video, audio, software code, user interface design or logos for or of Reliant.

TIMELINESS OF CONTENT

All content on SAFEHealth is presented only as of the date published or indicated, and may be superseded by subsequent events or for other reasons.

DISCLAIMER OF WARRANTIES

Reliant and you shall defend, indemnify, and hold harmless each other, each other’s officers, employees, and agents from and against any and all third-party claims, liabilities, damages, demands, losses, causes of action and suits, including reasonable attorney’s fees incident thereto, to the extent they result directly from or out of (a) any injury or death of any person or damage to or destruction of any property caused by the negligent acts, errors, omissions or willful misconduct of either party; or (b) any violation of federal or state regulations, orders, rules or the violation of any other governmental entity by either party, its agents or employees; or (c) any breach of warranty or any negligent performance by either party or its obligations under this agreement.

SAFEHealth is made available to you "as is" and "as available" and Reliant Medical Group does not warrant that any defects or inaccuracies will be corrected.

Reliant Medical Group Inc. does not warrant that SAFEHealth will meet my needs, or that they will be uninterrupted, timely, secure or error-free. Reliant also makes no warranty that the results obtained from the use of SAFEHealth will be accurate or reliable, or that the quality of any products, services, information, or other material obtained by me through SAFEHealth will meet my expectations.

LIMITATION OF LIABILITY

Reliant will not be liable to me or anyone else for any consequential, incidental, special, direct, or indirect damages (including but not limited to illness, death or dismemberment that result from use, misuse or loss of use of the SAFEHealth and third party content, inconvenience or delay). This is true even if Reliant has been advised of the possibility of such damages or losses.

Reliant will not be liable to me or anyone else for any loss resulting from a cause over which such Reliant does not have direct control. This includes failure of electronic or mechanical equipment or communications lines (including telephone, cable and internet), unauthorized access, viruses, theft, operator errors, severe or extraordinary weather (including flood, earthquake, or other act of God), fire, war, insurrection, terrorist act, riot, labor dispute and other labor problems, accident, emergency or action of government.

MINOR ELIGIBILITY

Parents or guardians of minor children may give authorization to use SAFEHealth if agreed to by the healthcare provider. Minor children between the ages of 13 and 17 with permission from a parent and/or legal guardian should also provide their assent to use SAFEHealth.
